By all accounts True North Sports and Entertainment is going to announce the purchase of the Atlanta Thrashers and the proposed move of the team to Winnipeg today at 12 noon Eastern.
So.. what's next?
The NHL Governors have to vote on the relocation per the NHL By-Laws
36.5. In determining whether to consent to the transfer of a Member Club’s franchise to a different city or borough persuant to Section 4.2 of the Constitution, each Member Club shall be guided by the following considerations:
(a) Whether the Club in question is financially viable in its present location and, if not, whether there is a reasonable prospect, based on any of the considerations set forth in subsections (b) through (j) below, or for any other reason, that it could become financially viable there, either under its present ownership or under new ownership.
Note that the by-laws that that there must be no chance of the club making money in the current location.
What would happen if someone (say a Atlanta Thrashers fan who was a practicing lawyer) filed a suit against the NHL and True North Sports and Entertainment and got an injunction to prevent the team from moving until they can prove that they can't make money here?
Can we, the fans, make the NHL live up to it's own By-Laws?
